Your personal data will be processed by OMIE in order to manage your request to register as a market agent and to follow up the further contractual relationship and activities pursued as a market agent in the market managed by OMIE. In particular, OMIE will process personal data for the following purposes: (i) register and follow up of market agents, ensuring connections in the Iberian Electricity Market; (ii) ensuring an adequate level of security in commercial transactions.
The legal basis for the processing is the pre-contractual and, as the case may be, contractual relationship established through the Adherence Agreement (Article 6.1. b) GPDR).
Should the user provide personal data related to a data subject different than the user, the user guarantees that such data subject has consented to their personal data being provided to OMIE for the purposes of this purpose.
User will, in all cases, be responsible for the truthfulness, accuracy, validity and authenticity of Personal Data provided. OMIE reserves the right to exclude the registration of any users having provided false data and to seek all remedies available at law and in equity. In case of responsibilities arising from the breach of these conditions, user will respond of the consequences of such breach.
Personal data will be kept as long as the contractual relationship is in force. Once this period has ended, OMIE will keep the personal data duly blocked for a period of 5 years with the sole purpose of addressing any kind of liabilities that may arise or in general terms asserting, exercising or defending legal claims. Once the time limit for exercising legal actions has elapsed, your personal data will be deleted.
OMIE, will process your personal data under absolute confidentiality. Furthermore, it has implemented adequate technical and organizational measures to guarantee the security of your personal data and to prevent their alteration, loss, misuse, treatment and unauthorized access or theft, taking into account the state of the technology.
The user consents to the transfer of persona data and any other information that OMIE may hold or that is accessible through its information systems to the following entities, that will use it for their own purposes:
- (i) Red Eléctrica de España, S.A. (REE) for the purpose of performing its activities as the Spanish system operator.
- (ii) Redes Energeticas Nacionais S. A. (REN) for the purpose of performing its activities as the Portuguese system operator.
- (iii) Other TSOs or NEMOs with the purpose of fulfilling their functions and to optimally manage their information systems,
- (iv) To the competent regulators.
- (v) To any competent public authorities when required in accordance with the applicable legal or regulatory provisions.
The user consents that entities subcontracted by OMIE may access personal data and information to help OMIE manage its information systems. OMIE will ensure that any of such entities comply with applicable data protection regulations, that is also directly applicable to them.
